Disciplinary Actions & Terminations

In an increasingly litigious society, employers must ensure their disciplinary actions and terminations are managed appropriately. Also, it is necessary to ensure an individual is "engaged" and retained as part of a talent management strategy. Consultation with an experienced human resource professional is a key step towards achieving those goals.

It is necessary to ensure an individual is "engaged" and retained as part of a talent management strategy.

Discussing disciplinary cases and terminations before an action is taken provides the opportunity to view the case in light of the "tests for just cause" to be sure the actions of management are not seen as arbitrary and capricious. Even in "employment at will" states it is prudent to determine that the tests for just cause have been met. In the case of disciplinary or corrective action short of termination, it is also prudent to have a performance improvement plan developed so that the employee's behavior changes for the positive.
